Terms & Conditions 

By submitting the online application, you (“Affiliate”) are agreeing that you have read and understand these terms and conditions and that you agree to be legally responsible for each and every term and condition. 

You agree to provide us, Rocky Mountain Barber Company (“Merchant”) with truthful, accurate and complete registration information. Merchant has the right to verify the truth and accuracy of any registration information at any time. If any information is determined by Merchant to be misleading, inaccurate or untruthful, Merchant may restrict, deny or terminate your account and/or your access and participation in the Ambassador Program (“Program”). Once you submit your application, you may be emailed and asked additional clarifying questions. 

If any registration information changes after you have been accepted to the Program, you must immediately notify us at [email protected]. All information changes are subject to the approval of Merchant at its sole discretion and may be grounds for termination in the Program. 

Prohibited Activities. We may reject your application if we determine that your social media or website is unsuitable for the Program, including if it: 

• Promotes sexually explicit materials 

• Promotes violence 

• Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age 

• Promotes illegal activities 

• Incorporates any materials which infringe or assist others to infringe on any copyright, trademark or other intellectual property rights or to violate the law 

• Includes Merchant’s name or variations or misspellings thereof in its domain name 

• Is otherwise in any way unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically or otherwise objectionable to us in our sole discretion. 

• Contains software downloads that potentially enable diversions of commission from other affiliates in our program. 

• Promotes a website, social media account or any other digital asset owned by you or a third-party which is designed to resemble our website, social media accounts or other digital asset with the intention of leading customers to believe Affiliate is actually the Merchant. 

Pay Per Click Campaigns. Affiliates that advertise among other keywords or exclusively bid in their pay-per-click campaigns on keywords such as Rocky Mountain Barber Company, and/or any misspellings or similar alterations of these - be it separately or in combination with other keywords - will be considered trademark violators, and will be terminated from the Program. We will do everything possible to contact the affiliate prior to termination. However, we reserve the right to expel any trademark violator from our affiliate program without prior notice, and on the first occurrence of such pay-per-click bidding behavior.

Coupon Code Websites. Affiliates are not permitted to submit their Rep Code to discount websites or services (including, but not limited to, Knoji, Coupon Birds, Hot Deals, Dealspotr, Greenpromocode and Promosdaddy). Rep Codes appearing on these websites are subject to change or removal. We reserve the right to expel affiliates who have submitted their Rep Code to such websites, or whose Rep Code appears on these websites.

Rep Codes. Rep Codes are subject to change or removal at the Merchant’s sole discretion. While reasonable efforts will be made to contact the Affiliate during such an event, it is the Affiliate's responsibility to ensure the Rep Code they are using is current by checking the "Your Coupon Code" field in Refersion's affiliate dashboard.

No Tampering. You agree that you will not modify, circumvent, impair, disable or otherwise interfere with any tracking codes and/or other technology and/or methodology required or made available by Refersion and/or the Merchant to be used in connection with your use of any offer. 

Revisions. You will have access to reports that detail tracked activities generated by your efforts and any corresponding commissions that you have earned. Refersion and/or the Merchant reserves the right to revise any report made available to you at any time if we believe that the report contains an error or omission or otherwise requires an adjustment. 

Enhancements. We may notify you of any enhancements or changes to your content that we feel should be made, or to make sure that your links to our websites are appropriate. If you do not make the changes that we feel are necessary, we reserve the right to terminate your participation in the Program. 

Consent. Where required by law, you will obtain consent of end users to place tracking devices, such as cookies (including tracking devices enabled by Refersion at your request on your behalf) on such end users’ computers, including where required, information regarding the option to opt-out or remove cookies/tracking devices to the extent required under applicable laws. 

Commission Fees. Commissions fees under this program are payable only on eligible orders placed through the following domains: rockymountainbarber.com, rockymountainbarber.ca. Affiliates are not eligible to receive commissions through our B2B websites, rockymountainbarberwholesale.com/.ca. 

Exceptions. Commissions are not payable on any applicable sales tax. When discount codes are used by the customer, commissions are adjusted for the lower price paid. Affiliates using their own discount code to complete personal purchases may be denied commissions.

Referral Link Tracking. Cookie Days tracking require the visitor to use the same device and browser, not be using private browsing/incognito mode, and to not have cleared their cookie and browsing data in order to track properly. 

Commission & Business Details. All Commission & Business Details, including Conversion action, Cookie days, Commission type, Base Commission, and Additional Terms, are subject to change.

Payment. We use PayPal™ Payouts to send payment. The exact amount deposited into your PayPal™ account may differ slightly from the amount displayed in your Affiliate Dashboard as it is net of any fees charged by PayPal™ and is subject to currency exchange fluctuations beyond our control.

Legal Compliance. All Affiliates must comply with all federal, state/provincial and local regulations within your jurisdiction. This includes applicable governing marketing emails (i.e. CAN-SPAM Act, CASL), and all other anti-spam laws. 

Termination. Merchant reserves the right to terminate this Agreement and your participation in the Program at any time and without notice. If fraud or abuse is detected, Merchant shall not be liable to you for any commissions for such fraudulent sales. 

Discontinued Use. Upon termination you agree to discontinue use of all links, logos, banners and promotional materials provided to you by Merchant or Refersion. Affiliates terminated due to malicious publishing tactics may also have commissions revoked and face possible omission from the Refersion network.

Termination of Links. Refersion and/or the Merchant may terminate any links associated with any engagement. You must remove said links after being notified of any termination of the corresponding engagement. If links are not so removed, Merchant may redirect or disable such links as it determines in its sole discretion, with or without compensation to you.

Release. I, the Affiliate, hereby grant the Merchant permission to use, exploit, adapt, modify, reproduce, distribute, publicly perform and display, in any form now known or later developed, any photograph, video, review or content related to Rocky Mountain Barber Company that I or someone acting on my behalf creates and shares on social media or with Rocky Mountain Barber Company (“Shared Content”), throughout the world, which may include incorporating it into internet websites, online product listings, product packaging, publications, catalogues, brochures, magazines, photo exhibits, videos, products, and/or other media (the “Works”) or commercial, informational, educational, advertising, or promotional materials relating thereto. I acknowledge that I will not receive any compensation for the use of such Shared Content.

I release, and hereby agree to indemnify, defend, and save harmless Merchant, its agents and employees, any and all claims I, or any third party, may have now or in the future for invasion of privacy, right of publicity, copyright infringement, defamation or any other cause of action arising out of the use, exploitation, reproduction, adaptation, distribution, broadcast, performance or display of the Shared Content.

I waive any right to inspect or to approve any Works that may be created using the Shared Content and waive any claim with respect to the eventual use to which the Shared Content may be applied. The Shared Content may be used at the Merchant’s sole discretion, alone or in conjunction with any other material of any kind or nature except that the Merchant will not use the Shared Content for any criminal or illegal purposes or in a manner inconsistent with community standards of decency. 

I understand and agree that the Merchant is and shall be the exclusive owner of all right, title, and interest, including copyright, in the Works, and any commercial, informational, educational, advertising, or promotional materials containing the Materials.

I hereby grant Merchant the absolute and irrevocable right and unrestricted permission to use my name, likeness, image and social media in materials used to promote the Program to other potential Affiliates or products to customers.

Modification. We may modify any of the terms and conditions in this Agreement at any time at our sole discretion, with or without notice. Modifications may include, but are not limited to, changes in the payment procedures and Program rules. If any modification is unacceptable to you, your only option is to end this Agreement. Your continued participation in the Program following the posting of the change notice or new Agreement on our site will indicate your agreement to the changes. 

Confidential Information. You acknowledge that in connection with your participation in the Program you will be provided with confidential and proprietary data and information from time to time. You agree to keep confidential information, including reports, data and other information provided to you through the Program or otherwise strictly confidential.
